NOTICE OF A
COMPLETE APPLICATION AND A
PUBLIC MEETING CONCERNING A
PROPOSED ZONING BY-LAW AMENDMENT
TAKE NOTICE THAT the Town of Penetanguishene deemed the following application to amend the Town’s Zoning By-law 2000-02, as amended, a “complete” application under Section 34 of the Planning Act, R.S.O. 1990 on the 23rd day of January, 2019.
TAKE NOTICE THAT pursuant to Section 34 of the Planning Act, R.S.O. 1990, the Council of the Corporation of the Town of Penetanguishene will hold a Public Meeting on Wednesday March 13, 2019 at 7:00 p.m. in the Council Chambers, Townhall, 10 Robert Street West, Penetanguishene to consider a proposed Zoning By-law Amendment.
The proposed Zoning By-law Amendment (Z.A. 10/2018) relates to lands legally described as Part of Lots 8 and 9 on Registered Plan 404 and further described as Parts 1 to 6 (inclusive) on Reference Plan 51R-22056. The property was formerly known as 31 Lucy Street and is now known as 45 Edward Street.
THE PURPOSE AND EFFECT of the proposed Zoning By-law Amendment is to add as an additional use a “Cancer Support Centre” and to decrease the required building setback from the Interior Side Yard from 4.5 metres to 1.5 metres. Additionally, the application requests to reduce the parking area setbacks from the required 7.5 metres in the Front Yard and Exterior Side Yard to 5.7 metres and 3.0 metres respectfully. The effect of the application would be to permit the construction of a new Institutional building, specifically a “Cancer Support Centre”, having a reduce Interior Side Yard setback and to permit a parking area with reduced setbacks.
AND FURTHER TAKE NOTICE that pursuant to Section 34(10.11) of the Planning Act, the Application file is part of the public record and is available to the public for inspection. If you are submitting letters, faxes, emails, presentations or other communications with the Town concerning this application, you should be aware that your name and the fact you communicated with the Town will become part of the public record. The Town will also make your communication and any personal information in it available to the public, unless you expressly request the Town to remove it. Any person may attend the public meeting and make oral or written representation either in support of, or in opposition to, the proposed Zoning By-law Amendment. If a person or public body does not make oral submissions at a public meeting or make written submissions to the Town of Penetanguishene before a zoning by-law amendment is passed, the person or public body is not entitled to appeal the decision of the Council of the Town of Penetanguishene to the Local Planning Appeal the Tribunal. Also, if a person or public body does not make oral submissions at a public meeting, or make written submissions to the Town of Penetanguishene before a by-law amendment is passed the person or public body may not be added as a party to the hearing of an appeal before the Tribunal unless, in the opinion of the Board, there are reasonable grounds to do so.
ADDITIONAL INFORMATION regarding the proposed amendment is available to the public for inspection at the Penetanguishene Municipal Office between 8:30 a.m. and 4:30 p.m. Monday to Friday.
