Notice of Passing By-law 2018-39
NOTICE OF THE PASSING OF A ZONING BY-LAW AMENDMENT
BY THE CORPORATION OF THE TOWN OF PENETANGUISHENE
TAKE NOTICE THAT the Council of the Corporation of the Town of Penetanguishene passed By-law 2018-39 on May 23, 2018 under Section 34 of the Planning Act, R.S.O. 1990.
By-law 2018-39 pertains to lands legally described Part of Lots 73 and 74 Plan 1521 and more particularly described as Part 5 on Reference Plan 51R-3896, Parts 1 to 3 inclusive Reference Plan 51R-19385 and Part 1 on Reference Plan 51R-32001 and municipally known as 173 and 177 Robert Street East. (see location map).
THE PURPOSE AND EFFECT of the Zoning By-law Amendment to site specifically amend the Industrial Services Zone (M1) to an Industrial Services Exception Three Zone (M1-3) to increase the maximum permitted Lot Coverage from 50% to 70% and to provide a new definition as it relates to this exception for Lot Coverage from Gross Floor Area to Ground Floor Area. The effect of the application is to permit the redevelopment of the property as a Marijuana Production Facility with an increased building footprint than currently permitted under the Zoning By-law
AND TAKE FURTHER NOTICE that any person or agency may appeal the By-law by filing with the Clerk of the Town of Penetanguishene, not later than June 14, 2018, a notice of appeal on the requisite Local Planning Appeal Tribunal Form setting out the objection to the By-law and the reasons in support of the objection, accompanied by the fee prescribed under the Local Planning Appeal Tribunal in the amount of $300.00 which must be in the form of a cheque payable to the Minister of Finance. Only individuals, corporations and public bodies may appeal a by-law to the Local Planning Appeal Tribunal. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf. No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Local Planning Appeal Tribunal, there are reasonable grounds to add the person or public body as a party.
CORRESPONDENCE RECEIVED from the public and external agencies on the proposed amendment were summarized and included in Staff Report PD-18-27 for the Public Meeting on April 11, 2018. Comments received at or after the public meeting were summarized and considered in the preparation of the final Zoning By-law and were included in Staff Report PD-18-29 for the Committee of the Whole meeting on May 9, 2018
